In December 1932, the Third Central Meeting of KMT Conference the Forth Session passed a resolution on starting the Constitutional draft work as soon as possible. In January 1933, according to the resolution, the Legislative Yuan organized a Constitution Drafting Committee to carry out the Constitution drafting work. 25 drafting principles were made as follows:
1.The Republic of China is a republic under the Three Principles of the People
2.The sovereign rights belong to all people of the Republic of China
3.The territory of the Republic of China is mentioned in a general sense. The Territory shall not be altered without the resolution of the National Assembly
4.The National flag of the Republic of China is with the design of red land, and blue sky & white sun at the upper left corner.
5.All people of the Republic of China are all legally equal, ignoring sex, race, religion, position and career.
6.The people of the Republic of China enjoy Rights of Voting, recall, Initiative and Referendum
7.The people enjoy the freedoms of person, of movement, of residence, of expression, of writing, of belief, of association and of assembly.
8.The people have obligations to pay tax, to serve in the army and public duty
9.Each county shall elect one representative to form the National Assembly. The election of the representative shall be done in the normal and direct way.
10.All citizens over 20 years old enjoy the right of voting representative. All citizens over 25 years old enjoy the right to be elected as the representative.
11.The National Conference shall be called every three year with duration of one month. Special meetings may be called if necessary
12.The authority of the National Assembly is to elect or dismiss the important official of the central government, to review and formulate laws, to revise the Constitution and to examine and approve the reports from all Yuans
13.Duties and responsibilities concerning central government will be listed.
14.Duties and responsibilities concerning local government will be summarized.
15.The President and vice president shall be elected by the National Assembly. Armymam shall not be elected as the presidents unless retired from army.
16.The President is the chief of the state. He is not to take direct executive responsibilities.
17.The Ministor of the Executive Yuan can be appointed or dismissed by the state President on the approval of the Legislative Yuan.
18.The president of The Examination Yuan, the president of The Judicial Yuan, Legislators and the Control Yuan members shall be elected by the National Assembly. The president of The Legislative Yuan, the president of the Control Yuan shall be elected by members of the corresponding Yuans.
19.The judicial administration is under the authority of the Judicial Yuan.
20.The President's term of office is six years and he shall not be reappointed. The term of office for president of The Examination Yuan, the president of The Judicial Yuan, legislators and The Control Yuan members is three years
21.The number of legislators shall not exceed 200. The number of The Control Yuan members shall not exceed 50
22.Provincial constitutions are not to be formulated for each province.
23.Provinces adopt the system of Provincial Governor Responsibility. The provincial government should be elected by the people. However, before all counties of the province realize autonomy, the provincial government will be appointed by the central government for the time being.
24.The Provincial Council, Provincial Government and Provincial Citizen Representative Council should be established for each province.
25.The county system is drafted according to the last will of the National Father without set up other principles.
