1.The Original Organization of the National Assembly
The National Assembly is organized by the Assembly members. According to the Amendments of the Constitution approved in 1997, the Assembly members are elected through general, equal and direct ballot by the people of all the legal regions. In addition, 80 domestic seats are decided by the proportion of votes of various political parties. Emigrated citizens have 20 seats. These are not restricted by Article 26 and 135 of the Constitution.
1.In free regions, two members shall be elected for every city and county directly under jurisdiction. But for places with a population of more than 100 thousand, one representative is added for every 100 thousand people.
2.In free regions, indigenous people living in plains and mountainous regions each can elect three members.
3.20 members for emigrants.
4.80 members throughout the state with no regional division.
Of the 5-10 members elected in the cities under direct jurisdiction, there should be one seat for female members. If the seats exceeded 10, for every ten seats there should be a seat for female members. The quota in the third and fourth items is decided according to the proportion of votes of different political parties. For these seats, there should be one seat for female members in every four seats.
According to Article 1.6 in the Constitution, the Assembly members should be reelected in every four years. The Article 1.28 of the Constitution is not applicable here.
The National Assembly used to have a presidium of 33 seats. To promote the efficiency of discussion, the posts of a Prolocutor and a Vice Prolocutor are established from the third session onwards. The Prolocutors are voted in by the members. They represent the National Assembly and preside over the meetings.
The first Prolocutor and Vice Prolocutor were elected on the July 8, 1996. Representative Chian Fu was elected the Prolocutor of the third session of the National Assembly. Representative Shie Longsheng was elected the Vice Prolocutor of the third session of the National Assembly. On February 6, 1998, Mr. Chian resigned from the post when he was nominated by the President as the third President for the Institute of Supervision. At the same time, Vice Prolocutor Shie also would like to resign from the post due to health problems. The Prolocutors were reelected on the January 13, 1999. As a result, the members Su Nancheng and Chen Jinrang were elected Prolocutor and Vice Prolocutor. On the September 8, 1999, Mr. Su resigned from his post. According to the Organization Law of the National Assembly, the Vice Prolocutor, Mr. Chen Jianrang became deputy Prolocutor.
